PRACTICE AREAS

Criminal Law
If the unfortunate circumstances should arise that you are accused of a crime, you should be aware of your substantial rights. Typically, at some point in the initial part of your arrest you will be read the Miranda warnings by law enforcement. These warnings are to be taken very seriously, and you should strongly consider heeding the warning that you have a right to remain silent. The fact that you elect to refuse to answer any law enforcement questions cannot and will not be held against you. Subsequent to your arrest, you may be incarcerated or released on your recognizance to appear in court on a set date. If you are jailed, you have a right to bond. Bond is an amount of money posted by yourself or by a bail bondsman to assure your appearance in court. If you post a cash bond, you will receive your money at the end of your case. In some jurisdictions court costs, fines and other fees may be deducted from your bond. If you use a bondsman, the bonding service will typically require 10 to 20 percent down payment, and the agency will then post the balance of the bond. You will not receive a refund of your down payment.

It is important to remember that under our system of justice you are presumed innocent until proven guilty by evidence that is so strong and so convincing that it is beyond a reasonable doubt. It is important that you retain an experienced and dedicated law firm with litigation trial experience.

Personal Injury
If you are injured by the negligence or intentional conduct of another person, you may have a cause of action to recover your damages. In many instances the negligent individual carries automobile insurance or malpractice insurance. If the negligent individual causes you harm while in the course of their employment for a company, the company may be responsible, as well as their individual insurance carrier. It is important for you to contact a competent law firm as soon as possible after injury to inquire about the nature of your case and any time limits or statutes of limitation that must be met by the filing of your claim. If you do not file your claim within the applicable statute of limitations you will be forever barred from making your claim. The elements of damage that you may recover in a personal injury lawsuit include loss of income, permanent disability, pain, suffering and mental anguish, permanent disfigurement, your medical bills and expenses. In order to prevail at trial, you must prove your case by clear and convincing evidence. It is important to retain a law firm that is experienced and able to persuasively communicate with the opposition or with the court or jury in order to effectively convey all aspects of your claim.

Divorce and Family Law
.Divorce is one of the most stressful aspects of anyone’s life, especially when young children are involved. As a divorcing spouse you have many rights, including the right to a full and equitable division of all assets. It is common that one spouse does not fully understand or is not aware of the nature and extent of the family’s assets. These assets could be hidden by the other spouse. It is important to hire aggressive attorneys who have the ability to utilize court procedure to discover all assets. In addition to division of assets, another important part of the divorce process is the establishment of maintenance. Maintenance is another term for alimony or spousal support provided by one party with substantial earning capacity to the other.

Of course, the most important part of any divorce involving young children is their care and custody. The courts will look at what is in the best interest of each minor child in deciding which spouse should have the residential custody of that child and the nature of the visitation rights for the nonresidential parent. Evidence must be gathered and presented to the court in a persuasive manner to conclusively demonstrate which spouse should have custody and for what reasons.
